Antioch among 15 cities eligible to participate in ADU Accelerator Program

SACRAMENTO – Senator Steve Glazer, D-Contra Costa, announced a newly created program to encourage the construction of hundreds of Accessory Dwelling Units in Contra Costa and Alameda Counties.

The ADU Accelerator Program, secured in the budget through Senator Glazer’s efforts, offers rebates of up to $15,000 for qualifying ADU plans and projects. This $2.5 million state-funded initiative is intended to facilitate the construction of 350 ADUs among the 15 cities and towns in the East Bay.

“It is no secret the State of California is facing a shortage of available and affordable housing, and no one knows this better than our local cities and towns,” Glazer said. “From my first days in the State Senate, I have been a staunch supporter of cities seeking new and unique ways to spur the production of housing while blending new developments within the fabric of their communities.”

“I’m hoping that cities in my district can show what can be achieved when cities work together with the state on an incentivized program aimed at producing more affordable housing,” Senator Glazer said.

The program, approved in the 2023 budget, will be administered by the California Department of Housing and Community Development.

The 15 cities are: Antioch, Brentwood, Clayton, Concord, Danville, Dublin, Lafayette, Moraga, Oakley, Orinda, Pittsburg, San Ramon, Walnut Creek in Contra Costa County and Livermore and Pleasanton in Alameda County.

Qualifying cities must have a Certified Housing Element that meets the substantial compliance requirements of Housing and Community Development.

Below is an overview of the new program along with guidelines to apply and receive funds.

Senate District 7 – ADU Accelerator Program | GUIDELINES

Program Overview

Some cities are taking steps to encourage and facilitate the construction of ADUs through the development of permit-ready plans, including architectural design work. Other cities are waiving processing fees to bring down the cost of housing.

This new program will be piloted by Senator Glazer’s District 7, composed of 15 cities in the East Bay of the San Francisco Bay Area. The program will be administered by the California Department of Housing and Community Development for the purpose of advancing or “accelerating” the production of 350 ADUs through a series of programs.

Program Funding

Section 19.564 of the Budget Act of 2023 provides $2,500,000 to be allocated by the California Department of Housing and Community Development for implementation of the ADU Accelerator Program (“Program”) to grant funds to cities for the creation of pre-approved permit-ready accessory dwelling unit plans and an incentive program.

Program Eligibility

  • Fifteen (15) cities located in Senate District 7, including: Antioch, Brentwood, Clayton, Concord, Danville, Dublin, Lafayette, Livermore, Moraga, Oakley, Orinda, Pittsburg, Pleasanton, San Ramon, and Walnut Creek.
  • Qualifying cities must have a Certified Housing Element that meets the substantial compliance requirements of Housing and Community Development.

Program Details

1.      Incentive Program. Available Funding: $1,725,000

A.    Low-Income Restricted ADUs

Provide individual rebates of up to $15,000 to property owners who obtain building permits to construct an ADU and receive a certificate of occupancy within 18 months of issuance. Rebates will be provided for units that are deed restricted to low-income households for a minimum of 20 years; based upon the following sliding scale:

  • $15,000 for units < 50 square feet
  • $10,000 for units between 501-750 square feet
  • $5,000 for units between 751-1,000 square feet
  • No rebates for units over 1,000 square feet.

B.     Non-restricted ADUs

Provide individual rebates of up to $7,500 to property owners who obtain building permits to construct an ADU and receive a certificate of occupancy within 18 months of issuance. Rebates will be provided for units that are deed restricted to low-income households for a minimum of 20 years. Funds are awarded based upon the following sliding scale:

  • $7,500 for units < 50 square feet
  • $5,000 for units between 501-750 square feet
  • $2,500 for units between 751-1,000 square feet
  • No rebates for units over 1,000 square feet.

Example:

  • City of Dublin has a population of 72,917 (as of January 1, 2024)
  • Per Capita: $1.87
  • Eligible for Award of $136,352 ($1.87 per capita x 72,917 population)
  • Divided by average of $5,000 per unit (unrestricted)

Potential ADUs Added: 27 ADUs

2.      Permit Ready Prototype ADU Plans. Available Funding: $750,000

Qualified cities receive funding toward preparing prototypical permit-ready ADU plans (“ADU Plans”), including design elevations and construction drawings. Permit-ready plans are intended to streamline the ADU development process and facilitate additional ADU development in the community. Cities may partner with other cities on applications in this category to leverage investment. The maximum grant per city will be $50,000.

Cities may not be reimbursed for permit-ready ADU plans that were prepared prior to the launch of this program. Program funds may be used to modify or update existing permit-ready ADU plans or to create additional permit-ready ADU plans. Cities may also seek compensation from other eligible cities they share plans with.

Application Process

To receive funds, qualified cities must complete and submit an electronic application to the Town of Danville, Fiscal Agent. All funds must be expended as prescribed below and no later than September 30, 2026, after which these funds would be considered unexpended “Excess Funds” subject to re-allocation. 

Incentive Program

An application must include (a) the anticipated number of units proposed to be produced through the program; and (b) amount requested based on the per capita amount identified in the Funding Eligibility section.

Funding will be distributed to cities upon receipt of the application. Any unused funding must be returned to the Town of Danville, Fiscal Agent, at the end of the 18-month period and may be reallocated to cities that meet their targets and have additional need.

Permit-Ready Prototype ADU Plans

An application must include (a) brief description of the plans to be developed including the number of floor plans and ADU sizes; and (b) requested funding amount. The maximum funding is $50,000 per agency. Cities may partner with other eligible cities on applications in this category to leverage funding investment.

Funding will be distributed to cities upon receipt of the application. Permit-ready plans must be completed and available to prospective permittees within 12 months of grant award and include a city resolution adopting the ADU Plans.

Excess Funds

Any funding that has not been expended pursuant to these program guidelines by September 30, 2026, must be returned to the Fiscal Agent, the Town of Danville. These Excess Funds will be reallocated to other eligible agencies pursuant to the Incentive Program Guidelines. Funds will be re-allocated on a first come, first served basis. In the event of multiple requests, consideration will be given to which city or cities will generate the largest number of affordable units.

Application Deadlines

Applications are accepted via electronic submittal only

Incentive Program: September 1, 2024 – March 31, 2025 (may be extended if additional funds are available to be rolled over from the Permit-Ready program).

Permit-Ready Prototype ADU Plans: September 1, 2024 – March 31, 2025.

Program Administration

As authorized through the California Budget Act of 2023 and the California Department of Housing and Community Development, the Town of Danville will act as the fiscal agent (“Fiscal Agent”) to receive funding applications and distribute Program funds. The Town of Danville will receive a 1% fee ($25,000) for administering the program.

Contra Costa expands Basic Health Care coverage for uninsured illegal immigrants

Contra Costa Health is now offering affordable health care coverage to uninsured county residents who don’t qualify for Medi-Cal or CoveredCA. 

Potentially eligible residents can now call a financial counselor at 1-800-771-4270 to ask about enrolling in Basic Health Care, which offers coverage for primary care, medications, X-rays and more. 

While Medi-Cal has expanded to include undocumented residents, some of those residents earn too much money to qualify. And they are not eligible for CoveredCA because they’re undocumented. 

“We’re still seeing some people in our community fall through the cracks, unable to get health insurance,” said Gilbert Salinas, chief equity officer for Contra Costa Health (CCH). “Basic Health Care will help fill that gap and give people access to medical care.”

Earlier this year, the Board of Supervisors made undocumented residents eligible for Basic Health Care. It’s estimated that more than 10,000 undocumented residents in Contra Costa are eligible for Basic Health Care. 

To qualify for Basic Health Care, residents must have incomes below 300% of the federal poverty level. People enrolled in Basic Health Care will pay a sliding-scale quarterly premium depending on their income up to $20 a month. Enrollment in this program will not be considered as part of a public charge test for immigrants.  

Basic Health Care enrollees will be able to access care at Contra Costa Regional Medical Center and the County’s outpatient health centers.  

“By improving access to primary medical services through Basic Health Care, we aim to reduce unnecessary visits to local hospital emergency departments,” Salinas said.

Contra Costa agencies awarded $29.7 million in grants for Head Start early childcare programs

County, Mexican American Opportunity Foundation and The Unity Council receive funding to offer affordable care for 1,634 infants, toddlers, and preschool children

(Martinez, CA) – The Administration for Children & Families (ACF), a division of the U.S. Department of Health & Human Services (HHS), has awarded Head Start grants to three Contra Costa agencies. The five-year awards provide $29.7 million in the first year and similar amounts in each of the subsequent four to provide early childhood education (ECE) to infants, toddlers and preschool children throughout the County. 

The grant to Contra Costa County enables it to fully fund its current childcare centers, and to continue existing subcontractor partnerships with KinderCare, Aspiranet, Crossroads/Mt. Diablo Unified School District (MDUSD), and Tiny Toes.  Head Start is also directly funding the Mexican American Opportunity Foundation (MAOF) and The Unity Council to deliver services to Contra Costa children and families.

“We will have Head Start funding for a total of 1,634 slots in Contra Costa County,” explained District 5 Supervisor Federal Glover, Chair of the Contra Costa County Board of Supervisors. “We welcome MAOF and The Unity Council as partners that can help Contra Costa expand access to infant-toddler care and preschool, especially for our Spanish-speaking and immigrant families in parts of East, Central and West County.”

Contra Costa County Probation seeks applicants for Juvenile Justice Coordinating Council

Martinez, CA – The Contra Costa County Board of Supervisors is seeking applicants interested in serving on its 20-member Juvenile Justice Coordinating Council (JJCC). Regular meetings of the Council and other standing committees are held at least quarterly based on a schedule adopted by the Council; that schedule may be changed or augmented as needed. The following positions are vacant and will be held for a two-year term:

  • Two (2) At-Large youth seats, 14 to 25 years old residing or working within Contra Costa County
  • One (1) At-Large member residing or working within Contra Costa County

The JJCC is a multi-agency advisory body that contributes to the development and implementation of a countywide juvenile justice plan. It is composed of several critical parts; including, but not limited to, an assessment of existing law enforcement, probation, education, mental health, health, social services, drugs, alcohol, and youth resources, which specifically target both at-promise, as well as system involved youth, and their families.

The JJCC will also coordinate the work of governmental and non-governmental organizations engaged in activities designed to reduce the incidence of juvenile crime and delinquency in the greater community.  Further, the JJCC will develop information and intelligence sharing systems to ensure county actions are fully coordinated and equipped to provide data and appropriate outcome measures.  The body is composed of the following members:

Civil rights lawsuit filed against City of Antioch, Antioch Police, Child Protective Services claims neglect led to 2022 toddler’s beating death

Attorney says agencies “utterly failed in their duties” to protect 18-month-old girl abused by parents also named in suit

San Francisco, August 20, 2024 — A federal civil rights lawsuit was filed in the beating death of an 18-month-old child in Antioch, alleging that a litany of individuals and agencies charged with protecting the tiny girl utterly failed in their duties and led directly to her death as the result of trauma inflicted by her biological parents.

The case, filed last week in Federal District Court on behalf of the two older siblings of the toddler, names the following defendants as negligently responsible for her horrific death: the City of Antioch, Antioch Police Department, Contra Costa Child Protective Services, Contra Costa County Regional Health Foundation, and a childcare facility, The Learning Center (actually named, The Learning Experience – see below), as well as the toddler’s biological parents, Jessika Fulcher and Worren Young, Sr.

The child was removed from her parent’s custody within weeks of her birth in February 2021 because she was in danger of neglect and abuse. Yet, over the next 16 months, the very people and institutions who were supposed to protect the toddler and her siblings failed to report obvious signs of abuse and/or failed to take action to prevent further trauma to the girl.

The child died August 26, 2022, from trauma so severe that it severed her pancreas and caused bleeding in her brain, according to doctors and the lawsuit.

The lawsuit seeks unspecified monetary damages, including punitive damages against the agencies and individuals named as responsible in the legal action.

“This child–who was still learning to walk–was brutally tortured and died a horrific death, all because the entire system that was supposed to protect her failed this innocent 18-month-old child,” said Brett Schreiber, attorney for the plaintiffs and partner at Singleton Schreiber law firm. “While her parents committed the physical abuse that killed her, their abuse was entirely enabled and abetted by social workers, police, hospitals and day care centers who should have stopped them.”

A juvenile court judge removed the toddler from the custody of her parents in March 2021, shortly after her birth.  When the child was born, both she and her mother had methamphetamines in their systems. In addition, both parents had outstanding warrants in Georgia. The children were placed in foster care.

Within weeks of the judge’s decision, however, Contra Costa County Child Protective Services (CPS) began a process intended to lead to reuniting the children with the parents, beginning with a “case plan” requiring close supervision of the parents. The case plan required the parents to submit to regular drug testing. The suit alleges that they missed half these mandated tests and failed many that they took.

A doctor at Pittsburg Health Center further noted injuries on the toddler, but neither the doctor nor the hospital notified CPS, and CPS never requested the hospital’s records.

Nonetheless, CPS soon allowed overnight visitations for the children with the parents, and by September 2021 enabled the parents to regain custody by concealing these and other facts from the judge.

The toddler returned to a household in turmoil, with Antioch police visiting the home at least three times in 2022. Yet the children remained in the home and no referral to CPS was made, even though the father was finally arrested for domestic violence and battery. The child’s daycare center, The Learning Center in Antioch, also alerted the mother regarding significant bruising on the toddler yet failed to make a mandated referral to CPS.

On August 25, 2022, Antioch Police Department officers and paramedics were called to the child’s home by her mother who reported that the girl was having trouble breathing. The girl was rushed to the hospital where doctors discovered she was the victim of severe, intentional injuries.

Her parents left the hospital during the night saying they were going out to smoke, but never returned. The girl died the following morning; a juvenile court hearing in April 2023 concluded that one or both parents were responsible for the fatal injuries.

“This was a complete dereliction of duty that resulted in the death of one young child and the lifelong loss and trauma for two others,” Schreiber said. “On behalf of those siblings, we are asking the court not only to compensate them for the life-long emotional scarring they will suffer, but also to punish those who failed to prevent this horrible tragedy so that it never happens again.”

Antioch City Attorney Thomas L. Smith and Interim Antioch Police Chief Brian Addington were asked on Tuesday afternoon if they had any comment about the lawsuit. Addington was also asked if lawsuits naming the police department are received by the chief or if they are handled by the city attorney’s office. Neither responded by publication time Wednesday evening.

Asked if the County had any comment on the lawsuit, Tish Gallegos, Community Relations and Media for the Contra Costa County Employment & Human Services Department responded, “The County has not been served with the lawsuit, therefore has no comment at this time.”

Asked whom at the County was served with the lawsuit, Sam Singer, of Singer Associates Public Relations representing Singleton Schreiber said, “I know the lawsuit was filed but it may not have been served, yet.”

The press release shows the case is O.Y., W.Y., and A.Y. v. County of Contra Costa, City of Antioch, Jessika Fulcher, Worren Young, Sr., Colleen Sullivan, Flynne Lewis, Contra Costa Regional Health Foundation, The Learning Center, Raji Ponnaluri, and Does 1 through 50filed in U.S. District Court for the Northern District of California.

Correction, Details Provided on Named Parties

However, the name of the business is actually, The Learning Experience.

Provided with that information and asked how Sullivan, Lewis and Ponnaluri are related to the lawsuit, Singer shared details from the lawsuit, including: “over the next year, from March 2021 to April 2022, during the pendency of the dependency action, CPS workers—Defendants in this action— abysmally failed to protect O.Y. and W.Y. Defendants Colleen Sullivan and Does 1-10, CPS employees, repeatedly misled and deceived the juvenile court. They represented that Defendant Parents were complying with the court’s orders documented in a ‘case plan,’ when, in fact, Defendant Parents were violating the terms of the case plan.”

Singer also shared, “defendant Flynne Lewis was a pediatrician practicing medicine at the Pittsburg Health Center who was responsible for the health, safety, and welfare of Decedent O.Y. and Plaintiff W.Y. Defendant Lewis and staff working at the Pittsburg Health Center noted and documented signs of abuse and neglect of O.Y., but failed to report such information to CPS or any law enforcement agency.”

Finally, Singer provided details about the correct name for the business and its owner which reads, “At all relevant times, Defendant The Learning Experience was a daycare center located at 4831 Lone Tree Way, Antioch, CA 94531 which was owned and operated by Defendant Raji Ponnaluri.”

Contra Costa health officer recommends indoor masking again to reduce risk of rising COVID-19 infection

With evidence of increased COVID-19 infections throughout the Bay Area, Contra Costa Health (CCH) recommends masking in crowded indoor settings, particularly for those at high risk of serious illness if infected.

This recommendation is not a health order. It aligns with existing state requirements and recent advice issued in neighboring counties.

A particularly infectious strain of COVID-19, FLiRT, is currently spreading throughout the western U.S., and drives the current surge. Wastewater sampling from the county shows a steady increase in the presence of the virus.

From May 9 to July 9, for example, state lab testing of wastewater samples from the Central Contra Costa Sanitary District showed that concentrations of COVID-19 more than quadrupled. Recently, wastewater concentration has plateaued but still remain high.

Health agencies across the Bay Area jointly lifted most of their requirements and orders to mask indoors in February 2022, but strongly recommended use of masking, particularly for those who are high risk for serious illness, as a prevention measure whenever COVID-19 case rates grew high.

“Face masks are an effective tool to reduce the spread of the virus, particularly for those who are at risk for serious illness when there is evidence of elevated COVID-19 activity in the community,” said Dr. Ori Tzvieli, Contra Costa County’s health officer. “This is one of those times. Our health system is not seriously impacted by COVID currently, and our goal is to keep it that way.”

Wearing a well-fitting mask, such as an N95 or KN95 respirator, is a healthy choice indoors, particularly in public spaces or if around people with whom you do not live.

Contra Costa’s only standing COVID-related health order requires workers at healthcare facilities to mask seasonally, from Nov. 1 to April 30 each year, to reduce risk to patients from COVID-19, flu, and respiratory syncytial virus (RSV).

However, workers and visitors to healthcare facilities, including skilled nursing and congregate care facilities, are strongly encouraged to mask now in those settings.

Health guidance for schools and community colleges remains unchanged. But with the school year beginning this month for most campuses in the county, CCH recommends encouraging students and faculty, particularly those who maybe at risk for serious infection, to mask within classrooms and providing masks to anyone who asks for them, when possible.

Other important ways to protect against COVID-19 are to remain up to date on vaccination, testing for COVID-19 whenever you have symptoms, and staying home from work or school whenever you feel ill. Additionally, treatments remain available for COVID 19 for those who may be at risk of serious illness.

Contact your healthcare provider for advice on vaccination, testing and treatment when you are ill. An updated vaccine to protect against COVID-19 infections is expected to be available in late summer or early fall.

Home test kits are available from healthcare providers and pharmacies throughout the county. Check with your healthcare provider or insurer about any cost or copay for testing or test kits.

A Contra Costa resident died this month from West Nile virus infection, underscoring the need for everyone in the county to take precautions against mosquito-borne illness.

The death of an adult man who lived in East County was reported to the county on July 16. It was the first West Nile virus-related death reported in Contra Costa since 2006.

“This is a tragedy, and we offer our deepest condolences to the family and loved ones for their loss.” said Dr. Meera Sreenivasan, deputy county health officer. “This death also reinforces how important it is to reduce risk of West Nile virus infection by reducing our exposure to mosquitos.”

Contra Costa Health’s (CCH) Communicable Disease Program is investigating the case and has not determined where the person became infected. To preserve medical privacy, CCH will not release further details about the case.

The Contra Costa Mosquito and Vector Contra District (District) has detected other recent evidence of the virus’s presence in East County. One dead bird and five sentinel chickens have tested positive for the virus in Contra Costa County, all located in Oakley. According to the Delaware Journal of Public Health, “Chickens serve as valuable sentinel animals since they are not effective amplifying hosts, and they develop a short and relatively low viremia compared to other bird species when infected by WNV.”

Certain birds can become infected with West Nile virus, and when a mosquito feeds on an infected bird, the mosquito can become infected. An infected mosquito can spread the virus to a human or other animal through a single bite. The infection can be dangerous to humans, with symptoms such as fever, headache, vomiting, or rash.

“We are deeply saddened by the loss of a Contra Costa County resident to West Nile virus,” said Paula Macedo, Ph.D., district general manager. “This tragic event serves as a stark reminder of the importance of protecting ourselves from mosquito bites and supporting community efforts to control mosquito populations.”

West Nile virus activity is typically higher during the summer months. To reduce the risk of mosquito bites, the District recommends using U.S. Environmental Protection Agency registered insect repellents with one of the following active ingredients:

  • DEET
  • Picaridin
  • The repellent version of Oil of Lemon Eucalyptus
  • IR3535

Always follow the instructions on the label when using insect repellent. Wearing long sleeves and pants when outdoors where mosquitoes are present, often at dawn and dusk, can reduce exposed skin and reduce the risk of mosquito bites. And dumping out any amount of standing water in front and backyards and scrubbing the inside of each container to remove mosquito eggs can also help lower the risk of mosquitoes.

Contra Costa County residents can help the District identify areas of potential WNV risk by reporting dead birds to the California Dead Bird Call Center by phone at 1-877-968-2473 or online at westnile.ca.gov. Dead birds are often the first sign of West Nile virus in a particular area. By reporting dead birds, residents provide the District with critical information that allows District employees to set mosquito traps near the site of the dead bird to look for infected mosquitoes. If those mosquitos are found, the District will take timely action to reduce the risk of mosquito-borne disease for neighboring residents.

A new government facility to better fit its environment

Includes new plaza, public law library

County and city officials celebrated the grand opening of Contra Costa County’s new Administration Building Tuesday morning, July 9, 2024. Located on Pine Street in the heart of downtown Martinez, the three-story cutting-edge office administration building and civic plaza was unveiled on the historic grounds previously occupied by a taller, outdated office tower and a jail dating back to around 1902. Both were demolished to make way for the modern development including the County’s other new administration building across Escobar Street that houses the Board of Supervisors’ Chambers.

Members of the Contra Costa County Board of Supervisors and the Martinez City Council, county staff and representatives of both Webcor Builders and design firm Perkins & Will gathered for the building’s grand opening.

Speakers included Board Chair and District 5 Supervisor Federal Glover, District 1 Supervisor John Gioia, District 2 Supervisor Candace Andersen, District 3 Supervisor Diane Burgis and District 4 Supervisor Ken Carlson, Chief Assistant County Administrator Eric Angstadt and Martinez Mayor Brianne Zorn, and representatives of design firm Perkins & Will and Webcor Builders.

The new $65 million building replaced a programmatically obsolete and contextually out of scale office tower and showcases state-of-the-art architecture that harmonizes beautifully with the surrounding historic buildings. It also rejuvenates the public plaza formed by the vacation of a city street within the County administration campus. It embodies sustainability with on-site photovoltaics for high-performance energy use, responsibly sourced finishes, and low embodied carbon materials.

The development significantly enhances community space by adding a new public law library, ground-floor retail spaces, and a parking garage. The plaza also includes street improvements and an advanced stormwater system tailored to the site’s unique groundwater challenges and topography. Internally, the building acts as a hub for several County administrative departments, including the Public Defender, County Sheriff’s Civil Division and the Office of Racial Equity and Social Justice, consolidating essential services under one roof to improve service delivery and enhance community interaction.

The new building marks a significant contribution to Contra Costa County, where modernity meets tradition and community service meets innovation.
